3. Developer Responsibilities
As a developer using Titan United Line's Developer Resources, you agree to the following:
Accurate Representation: Accurately represent yourself, your company, and your Application. Do not mislead users regarding the functionality or origin of your Application.
Security: Implement and maintain robust security measures to protect User Data and Transaction Data. This includes, but is not limited to, using strong encryption for all data in transit and at rest, protecting API keys and credentials, and regularly reviewing your systems for vulnerabilities.
Privacy: Strictly adhere to our Privacy Policy and all applicable data protection laws (e.g., GDPR, CCPA). You must clearly and accurately disclose to your users how their data is collected, used, stored, and shared in connection with your Application and Titan United Line's services. Obtain all necessary user consents before collecting or processing their data.
User Experience: Design and develop Applications that provide a clear, intuitive, and high-quality user experience. Ensure that the integration with Titan United Line's services is seamless and transparent to the user.
Regulatory Compliance: Ensure that your Application and your use of the Developer Resources comply with all applicable local, national, and international laws, regulations, and industry standards. This includes, but is not limited to, consumer protection, e-commerce, financial services, data protection, and intellectual property laws.
No Circumvention: Do not attempt to circumvent or undermine the security, integrity, or functionality of the Titan United Line Platform or its escrow processes.
No Reverse Engineering: Do not reverse engineer, decompile, or disassemble any portion of the Developer Resources or the Titan United Line Platform, except to the extent that such activities are expressly permitted by applicable law notwithstanding this restriction.
Responsible Use: Use the Developer Resources in a fair, ethical manner that does not place an undue burden on Titan United Line's infrastructure.
4. API Usage Guidelines
Where Titan United Line provides APIs for integration, the following guidelines apply:
API Key Management: Treat your API keys and credentials as confidential. You are solely responsible for all activities that occur under your API keys. Notify Titan United Line immediately of any unauthorized use or security breach related to your API keys.
Rate Limits: Adhere to any specified API rate limits to ensure fair usage and platform stability. Excessive requests or abuse may result in temporary or permanent suspension of your API access.
Intended Use: Use the APIs only for the specific purposes for which they are intended, as described in Titan United Line's documentation. Any unauthorized or unintended use is strictly prohibited.
Error Handling: Implement robust error handling mechanisms in your Application to properly handle API errors and ensure a smooth user experience.
Up-to-Date Integration: Keep your Application's integration with Titan United Line's APIs up to date. Titan United Line may update its APIs, and you are responsible for adapting your Application to any changes.
5. Data Security and Privacy
You acknowledge and agree to the following regarding data processing:
Data Minimization: Collect and process only User Data that is strictly necessary for your Application's functionality and its integration with Titan United Line.
Confidentiality: Maintain the confidentiality of all User Data and Transaction Data accessible through the Developer Resources. Do not disclose this data to third parties without the user's express consent and in compliance with all applicable laws.
Data Retention: Retain User Data and Transaction Data only for as long as necessary to fulfill the purpose for which it was collected or as required by law. Securely delete data when no longer needed.
Security Incident Reporting: Promptly report to Titan United Line any actual or suspected security breaches, unauthorized access, or misuse of User Data or Transaction Data.
6. Intellectual Property
Titan United Line IP: All Intellectual Property Rights in the Developer Resources, the Titan United Line Platform, the trademarks, logos, and any content provided by Titan United Line are solely owned by Titan United Line LLC. This Policy grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the Developer Resources solely for the purpose of developing and operating your Application in accordance with this Policy.
Your IP: You retain all Intellectual Property Rights in your Application, excluding any Developer Resources or Titan United Line content.
No Implied Licenses: No rights or licenses are granted by implication, estoppel, or otherwise under this Policy, except for the licenses expressly granted herein.
7. Compliance with Laws
You represent and warrant that your Application, its content, and your use of the Developer Resources will at all times comply with all applicable federal, state, and local laws, rules, and regulations, including but not limited to:
Consumer protection laws.
Laws regarding advertising and marketing.
Data protection and data security laws.
Anti-Money Laundering (AML) and Know Your Customer (KYC) regulations (if applicable to your specific integration).
Laws governing the sale and transfer of goods and digital assets.
8. Prohibited Activities
The following activities are strictly prohibited:
Illegal Activities: Using the Developer Resources for any illegal or fraudulent purpose.
Malicious Behavior: Introducing viruses, worms, trojan horses, or other harmful code or components.
Spamming: Sending unsolicited communications to users or abusing Titan United Line's communication channels.
Deceptive Practices: Engaging in deceptive, misleading, or unethical practices.
Harmful Content: Displaying or promoting content that is obscene, defamatory, harassing, discriminatory, or otherwise harmful.
Competing Services: Using the Developer Resources to create or provide a service that directly competes with Titan United Line's core escrow services, without express written permission.
Abuse: Misusing or infringing the intellectual property rights of Titan United Line or any third party.
Unauthorized Access: Attempting to gain unauthorized access to any part of the Titan United Line Platform or its systems.
9. Modifications and Termination
Policy Updates: Titan United Line reserves the right to modify this Policy at any time by posting the revised Policy on our website. Your continued use of the Developer Resources after such changes become effective constitutes your acceptance of the revised Policy.
Termination: Titan United Line may, in its sole discretion, suspend or terminate your access to the Developer Resources at any time, with or without notice, for any reason, including but not limited to a breach of this Policy, our Terms and Conditions, or any applicable law. Upon termination, you must immediately cease all use of the Developer Resources and delete all Transaction Data and User Data obtained through them.
10. Disclaimer of Warranties
The Developer Resources are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Developer Resources will be uninterrupted, error-free, or secure. Titan United Line LLC disclaims all such warranties to the fullest extent permitted by law.
11. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Titan United Line LLC, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to your use of the Developer Resources, even if Titan United Line LLC has been advised of the possibility of such damages. In no event shall Titan United Line LLC's total liability for all claims arising out of or relating to this Policy exceed the amount you paid to Titan United Line LLC for the use of the Developer Resources during the twelve (12) months prior to the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Titan United Line LLC, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Developer Resources; (b) your Application; (c) your breach of this Policy; (d) your violation of any law or the rights of any third party; or (e) any content or data you submit, post, transmit, or make available through the Developer Resources.
13. Governing Law and Dispute Resolution
This Policy shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of laws principles. Any disputes arising out of or relating to this Policy shall be resolved exclusively in the state or federal courts located in St. Petersburg, Florida, USA.
14. Miscellaneous
Entire Agreement: This Policy, together with our Terms and Conditions and Privacy Policy, constitutes the entire agreement between you and Titan United Line LLC regarding your use of the Developer Resources.
Severability: If any provision of this Policy is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver: The waiver of any right under any provision of this Policy shall not be deemed a further or continuing waiver of such provision or any other provisions.
Assignment: You may not assign or transfer any rights or obligations under this Policy without the prior written consent of Titan United Line LLC. Titan United Line LLC may assign its rights and obligations under this Policy without restriction.
