These Terms and Conditions ("Terms") govern your access to and use of the logistics and transportation services of Titan United Line LLC ("Titan United Line", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms, our Privacy Policy, and any other policies or agreements referenced herein or on our website.

Please read these Terms carefully before using our services. If you do not agree to these Terms, you may not use our services.

1. Introduction to Titan United Line Services

Titan United Line LLC, located at 1341 E Las Olas Blvd #1691, Fort Lauderdale, FL 33301, USA, provides comprehensive logistics and transportation services. Our portfolio includes, but is not limited to, efficient freight solutions, secure warehousing, professional customs clearance, and reliable delivery services for a wide range of goods – from innovative software and unique digital assets to used vehicles and the latest gadgets. Our goal is to optimize your supply chain and ensure the safe and timely transport of your goods.

2. Eligibility

To use the services of Titan United Line, you must be at least 18 years old and capable of entering into a legally binding contract. By using our services, you represent and warrant that you meet these eligibility requirements. Our services are available to individuals and legal entities.

3. How Titan United Line Works

3.1. General Logistics Process:

Inquiry & Quote: The customer (shipper) provides us with details of the shipment (type, quantity, weight, pickup and destination, timeframe). We then provide a customized quote including all services and costs.

Order Confirmation: Upon acceptance of the quote by the customer, the contract is concluded. We confirm the order in writing and coordinate the pickup.

Pickup & Transport: We organize the pickup of the goods at the agreed location and carry out the transport using suitable vehicles and optimal routes.

Customs Clearance (if applicable): For cross-border shipments, we handle all customs formalities on behalf of the customer, including the preparation and review of required documents.

Warehousing (if applicable): If desired, the goods can be temporarily stored in our secure warehouse facilities.

Delivery & Proof of Delivery: The goods are delivered to the recipient. We provide a proof of delivery (POD) showing date, time, and recipient's signature (if required).

Shipment Tracking: Throughout the entire process, you have the option to track the status of your shipment in real-time via our tracking tools.

3.2. Special Services by Item Type:

Software & Digital Assets:

Delivery: "Delivery" here does not mean physical delivery, but the secure transmission of data, access credentials, or licenses via encrypted channels. We ensure the integrity and security of the data during transmission.

Used Vehicles:

Transport: We organize the safe transport of vehicles, whether by truck (enclosed or open carrier) or by ship.

Documentation: We assist in compiling and reviewing all vehicle documents necessary for transport and customs clearance (title, registration certificate, export documents).

Gadgets & Other Physical Goods:

Packaging: We advise on and, if applicable, arrange for professional packaging to prevent transport damage.

Inventory Management: For merchants, we offer solutions for inventory storage, picking, and shipping individual orders (fulfillment).

4. Fees

Titan United Line charges a fee for its services, which is clearly communicated and agreed upon with the customer before the order is placed. Fees may vary depending on the type of service, distance, size, weight, value of the goods, and any additional services required (e.g., customs clearance, warehousing). All fees are due upon performance of the service and are generally non-refundable, provided the service has been performed in accordance with the contract.

5. Your Obligations

5.1. For Shippers/Customers:

Provision of accurate and complete information about the shipment (content, value, dimensions, hazardous goods class, etc.).

Ensuring that the goods are properly packaged for transport (unless this is done by us).

Timely provision of all documents required for customs clearance.

Compliance with all applicable laws and regulations related to shipping (e.g., export controls, prohibitions).

Payment of agreed fees.

5.2. For Recipients:

Acceptance of delivery at the agreed location and time (within a reasonable framework).

Immediate inspection of the goods for obvious transport damage upon delivery and notation of such damage on the delivery note.

Compliance with all applicable laws and regulations related to receipt (e.g., import regulations).

6. Security and Data Protection

Titan United Line uses industry-standard security measures to protect your data and, as far as possible, the security of your goods during transport and storage. We use secure IT systems, encryption, and work with verified transport partners. However, absolute security against theft, loss, or damage cannot be guaranteed for physical goods; for this, we refer to our liability provisions and the option of taking out insurance. You are responsible for the confidentiality of your account access data.

We collect, use, and store your personal data in accordance with our Privacy Policy. By using our services, you consent to this collection, use, and storage.

7. Dispute Resolution and Complaints

In the event of a complaint (e.g., transport damage, loss, delivery delay), the following procedure must be followed:

Reporting Damage: Obvious transport damage must be noted by the recipient immediately upon delivery on the delivery note. Concealed damage must be reported to us in writing without delay, but no later than within 7 days of delivery.

Reporting Loss/Delay: In case of loss of the shipment or significant delays, we request immediate written notification.

Review: We will review the complaint, possibly request information and evidence (photos, proof of value) from the customer, and clarify the matter with our transport partners.

Decision: We will endeavor to find an amicable solution. Liability is governed by legal provisions and the conditions stated in Section 8 (Limitation of Liability).

8. Limitation of Liability

8.1. Unless Titan United Line has acted with intent or gross negligence, we are liable – regardless of the legal grounds – only for damages resulting from the breach of a material contractual obligation. Material contractual obligations are those obligations whose fulfillment enables the proper execution of the contract in the first place and on whose compliance the customer may regularly rely. In these cases, liability is limited to the contract-typical, foreseeable damage.

8.2. For damage to goods, loss, or delivery delays, we are liable as a carrier according to the legal provisions of the German Commercial Code (HGB) or the respective applicable international conventions (e.g., CMR). Liability is limited in principle and amount to the sums provided for in these legal regulations, unless a higher value has been declared and corresponding insurance has been taken out.

8.3. Liability for other damages not affecting the goods themselves (e.g., business interruption, lost profits) is excluded, unless they are based on intent or gross negligence.

8.4. We recommend taking out transport value insurance for high-value shipments.

9. Indemnification

You agree to indemnify, defend, and hold harmless Titan United Line LLC, its affiliates, officers, directors, employees, agents, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

Your access to or use of our services.

Your breach of these Terms.

Your violation of applicable law or the rights of third parties (e.g., by shipping illegal or dangerous goods).

Incorrect or incomplete information provided by you regarding the shipment.

10. Termination

Titan United Line reserves the right to suspend or terminate your access to our services (e.g., customer account) in whole or in part, at its sole discretion, without notice, and for any reason, including, but not limited to:

Breach of these Terms.

Engaging in fraudulent or illegal activities.

Actions that could harm Titan United Line or other users.

Non-payment of outstanding invoices.

Already placed transport orders will not be affected by this and will be processed in accordance with the agreements applicable to them.

11. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of laws provisions. Any disputes, claims, or proceedings arising out of or relating to these Terms or your use of our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Fort Lauderdale, Florida, USA. You irrevocably submit to the personal jurisdiction of such courts for the purpose of litigating such disputes and waive any objection to venue based on lack of personal jurisdiction, improper venue, or inconvenient forum.

12. Changes to the Terms

Titan United Line reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and changing the "Last Updated" date. Your continued use of our services after such changes constitutes your acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements or policies referenced herein, constitute the entire agreement between you and Titan United Line LLC regarding your use of our services.
